Welcome to the website of MEL Mobile Entertainment Ltd ("Mobile" and "the site").Before using the site, please carefully read the site use terms and conditions ("the use conditions"), which constitute the basis of the contract with Mobile for using the site and for every representation, undertaking and purchase through the site.  By actually using and doing any acts through the site in any way whatsoever you declare and confirm that you have carefully read, understood, agreed to and accepted the use conditions and neither you nor anyone acting on your behalf will have any complaint, claim or demand against Mobile, apart from such as relate to the breach of express undertakings given in accordance with the use conditions. Subject to the use conditions, the expression "user" means whoever makes use of the site in any way whatsoever. The use conditions, the use and all acts through the site are governed by the laws of the State of Israel and are subject solely to Israeli law. The competent court in Tel Aviv ‑ Jaffa has sole and exclusive local jurisdiction in any matter or dispute relating to the use conditions, the use or to any cause deriving from any act done through the site.

Ordering Devices and Payment

The devices are ordered through the site by providing your name, ID number, credit card details and flight number. Mobile`s acceptance of the order is only after the order has been completed on site and finally approved. The time when the order is entered in Mobile`s computers will be regarded as the time of its acceptance. So long as the order has not been finally approved, you may withdraw and cancel it. You may only cancel the order after final approval by telephoning Mobile`s service representatives. Payment is solely by credit card.

Supply of the Devices

The devices ordered through the site will be supplied during the flight by EL AL Israel Airlines Ltd in consideration for payment and in accordance with the specified flight times, subject to delays due to factors and occurrences beyond the control of Mobile or the person responsible for supply.

Cancellations

A transaction that has been made through the site may be cancelled by written notice to Mobile no later than 14 days from the date of ordering the device.

The Site Content

The pictures on the site are designed solely for the purpose of illustration. Despite the effort made for the site, its contents, the products and services and the information contained therein to be complete, accurate and up to date, there might be inaccuracies or errors on the site that have been made in good faith and Mobile shall bear no liability for or in connection with them. For the avoidance of doubt, Mobile does not bear any liability for errors in typing, content descriptions, prices, payment terms, pictures or any other information in respect of the devices.

Prices and Price Lists

The prices for the hire of the devices offered on the site are inclusive of VAT and they are solely for purchases through the site. The final price that will be charged is the VAT inclusive price.

Intellectual Property Rights and Trade Marks

All the property rights and intellectual property in the site, including its design, programming, applications, computer code, graphics, pictures, video clips, design, text, specifications and all other information in and/or relating to the site ("the site content") are the sole and exclusive property of Mobile and no use of them may be made without Mobile`s authority. The Mobile Entertainment names and logos and all trade marks on the site and/or connected with those names belong to Mobile and are its sole and exclusive property. No use may be made of the trade marks unless prior written authority has been granted by Mobile.

Limitation of Use

None of the site content, items of information, products and services deriving from the site may be copied, restored, reproduced, distributed, displayed, loaded, transmitted, advertised, updated, sold, modified or commercially used in any way whatsoever, save subject to the use conditions or if prior written authority has been given by Mobile. Neither the site nor the site content may be used for any unlawful purpose. Direct or indirect use of the information existing in the site databases is strictly prohibited.

Limitation of Liability

The site is offered and presented in good faith, "as is", without any express or implied undertaking or representation on the part of Mobile. Mobile neither is no shall be liable to you for any direct, indirect, incidental, special, consequential or other damage including, but without prejudice to the generality of the aforegoing, damages for loss of use or data or for loss of direct or indirect profits, howsoever deriving from or connected with the use, copying or presentation of the site, in respect of a delay in the use of and/or inability to use the site and/or products purchased through it and/or otherwise deriving from use of the site, whether in contract or tort or on any other cause. Mobile does not undertake that the site services will be provided in order, will not be disrupted or stopped, will be maintained securely and without errors and will be immune from any unauthorised access to computers or from damages, faults, malfunctions or failures in Mobile`s hardware, software, communications lines and systems and Mobile will not bear any liability to you in the event of such disruptions or problems. In the event that Mobile is unable to perform its obligations and/or supply the devices or in the event of other disruptions such as inventory problems, shortages, delivery problems or the like, or problems by reason of force majeure or deriving from factors or occurrences beyond the control of Mobile, then, save for the right to cancel the order and have your account credited with the charge (insofar as made), Mobile will not bear any liability to you.

Privacy and Confidentiality of Information

The information given by you on the site is intended for the sole and exclusive use of Mobile and for the purpose of using the site and will be kept in a database in accordance with the Israeli Protection of Privacy Law, 5741-1981. Your agreeing to the use conditions constitutes agreement to the inclusion of the information in the database as aforesaid. Mobile undertakes to use its best efforts, by the means available to it, in order to safeguard, and frustrate possible infringement of, the privacy of the information given by you but it nevertheless cannot absolutely avoid the possibility of disruptions, mistakes and errors and it will bear no liability due to such infringements, malfunctions, disruptions, mistakes and errors that are caused as aforesaid. Mobile may contact you by email, in writing or orally with any information concerning special offers on the site and/or that Mobile has and/or concerning advertisements from selected commercial entities etc., in its discretion. If you are not so desirous, please specify the same in the first advertisement that is sent to you and return it to Mobile.

Further Conditions

Mobile reserves the right to modify the use conditions from time to time, in its sole and absolute discretion. Mobile is entitled to determine the products and services that can be purchased and/or ordered through the site and everything associated therewith and also to limit the order of products and services, all in its sole and absolute discretion. Mobile reserves the right at any time to terminate operation of the site and the use of the services offered on it, in its sole and absolute discretion and without warning. Mobile may modify the site, its structure, appearance, content, the scope of the services provided on it and anything else in its sole and absolute discretion without warning. The user will have no complaint, claim or demand against Mobile in respect of the making of such changes or malfunctions that occur due to making the changes.
